Socialstyrelsen har riktat kritik mot en rad kommuner i landet då de gamla som beviljas särskilt boende i kommunerna inte ges möjlighet att ansöka om hjälp för sin livsföring i övrigt vid inflyttningen till särskilt boende. Denna studie är en fallstudie där fem personer ur personalen på ett särskilt boende för äldre med fysiska funktionsnedsättningar intervjuats. Syftet med studien är att analysera beslutsprocessen som startar då en person utan beslut på hjälp för sin livsföring i övrigt ska flytta in på det undersökta boendet. För att få information om vilken hjälp den gamla som ska flytta in behöver för sin livsföring i övrigt kontaktar personalen på boendet personalen i hemtjänsten eller på korttidsboendet. Personalen på boendet gör även ett hembesök hos den gamla då denna hälsas välkommen och boendet presenteras. Beslutsprocessen som startar då en person ska flytta in på boendet är en process som pågår under de första veckorna efter inflyttningen och utmynnar i att en genomförandeplan upprättas. I strid med Socialstyrelsens föreskrifter bygger inte genomförandeplanen på boendet på redan beviljade insatser utan det är vid upprättandet av planen som det görs en överenskommelse om vilken hjälp den gamla ska få. Under de veckor som beslutsprocessen pågår och då planen upprättas är det omvårdnadspersonal utan delegering från socialnämnden som fattar beslut enligt Socialtjänstlagen. Detta innebär att rättsosäkerheten för de gamla blir stor då de inte har möjlighet att överklaga ett avslag.
Abstract [en]
The Swedish Social Welfare Board has directed critisism towards a number of counties across the country. When senior citizens have been granted sheltered housing they have not been given the opportunity of asking for support for their life in general when moving into residential care. This studie is a case studie in which five members of staff at a certain sheltered house for the elderly with pysical disabilities were interviewed. The purpose of this studie was to analyze the decision making process of a senior citizen, who has not been offered any help and is about move into the above mentioned sheltered house. To appreciate what help the elderly resident may need the staff contact their home help (if they are still living at home) or the staff at the short term accomodation. The staff also make a home visit where the new resident is made to feel welcome and informed about their new home. The decision process prior to moving in is an ongoing process during the first few weeks of becoming a resident and leads to an implementation plan being drawn up. Contrary to the boards regulations the implementation plan will not affect residency already approved, but is in preperation for what help the new residents will receive. During the weeks the decision making process is under way and when the plan is drawn, it is the nursing staff, without delegation from the Social Welfare Board who make the decisions, according to the Social Services Act. This means that the legal uncertainty for the elderly, with be considerable, as they will be unable to appeal against rejection.
