    Abstract [en]

    This paper introduces ESTER, a research based and computerized risk-need assessment system for youths (0-18 years) with or at risk for conduct problems. The ESTER-system includes a screening tool/questionnaire (ESTER-screening) and a professional structured risk-need assessment instrument (ESTER-assessment). This article briefly presents the background and purpose of ESTER, and the risk and protective factors assessed. It also illustrates how the computerized system effectively helps in presenting results of single as well as repeated assessments, assisting the practitioner in tailoring suitable interventions.

    Abstract [en]

    ESTER-assessment is a new assessment instrument for youths (0-18 years), and includes 19 empirically-derived risk and protective factors for conduct problems. This study tests the inter-rater reliability of the five-point rating scale used to assess the 19 factors in ESTER-assessment on 30 institutionalized girls and their file information. Exact agreement between raters varied from 38 to 72 percent on the 19 individual factors, a result much better than chance. Intra-class correlations of the two independent raters on the majority of the 19 individual factors were fair to good. In conclusion, the results lend support to the inter-rater reliability of ESTER-assessment.

    Abstract [en]

    Objective:  In the present paper we ask whether it is meaningful to study psychopathic traits in non-referred youths and whether this kind of research can be used to understand the development of criminal full-blown psychopathy.

    Method:  We review studies that have investigated the utility of assessing psychopathic traits in non-referred samples of youths.

    Results:  Research shows that psychopathic traits in non-referred youths manifest similarly to how they are manifested among incarcerated offenders, as indicated by similarities in factor structures. Also, psychopathic traits relate similarly to frequent, violent antisocial behavior in non-referred youths as among adult and adolescent institutionalized criminal offenders. Thus, the differences between the non-referred conduct-problem youths exhibiting a psychopathic personality pattern and the incarcerated, criminal youths identified as psychopathic seem to be quantitative rather than qualitative.

    Conclusion:  It is concluded that research on non-referred youth samples can provide important knowledge about the processes that underlie the development of psychopathic traits and how this development can be prevented. Implications for future research and intervention and prevention are discussed.

    Abstract [en]

    The topic of this master thesis in legal science is state law and constitutional law, or more specific judicalization, with the division of power and thus increased individual legal rights in various forms. Sweden has traditionally had a weak constitutional protection for the individual’s legal rights. The public power has been concentrated to the government and the courts have only played a marginal role. Since the implementation of the European convention of legal rights and with the ever-increasing importance of the legal system of the European Union, the Swedish legal system gone through changes of historical dimensions.

    This master thesis is based on the legal dogmatic method where laws, preparatory work, case law and doctrines have been systemized. The purpose of this thesis is to exemplify a global trend; the judicalization and its following consequence and implication on the national legal system. The aim is also to evaluate the constitutional protection in Sweden after the propositioned changes of Regeringsformen in a de lege ferenda-perspective.

    The conservative sovereignty of the Swedish people has been challenged by, from national standpoints, xenogeneic thoughts concerning division of power and increased power for the courts, which in turn puts the traditional democratic principles on their edge. An expert commission, Grundlagsutredningen, was put together to review the Swedish constitution, Regeringsformen. The review has resulted in a proposition which questions some important constitutional matters. The expert commission has propositioned a stronger judicial preview through the Swedish legal Counsel Lagrådet, and also suggested a stronger judicial review by changing the possibilities of the courts to try laws against the constitution. These changes, together with the fact that the autonomy and the increased power of the courts are stressed in a new chapter in Regeringsformen, imply that the political power has to take a step back. The development, the judicalization, clearly accentuates the judicial power on behalf of the courts. This in turn increases the protection for the individual’s fundamental human and legal rights. These incentives are of course hard to ignore as the Swedish constitution for once is competing on an international level. The new changes are positive as a corrective against for instance the abuse of power, and only case law can provide us with outcome in a prospective perspective.

    Abstract [en]

    With regard to small claims ordinary judicial proceedings may be disproportionate expensive in relation to the amount of the claim, especially in cross-border cases that often involve additional costs. This deters the EU citizens from pursuing small claims. In order to remove such obstacles a need for a European simplified procedure for cross-border small claims was expressed. Hence the European Small Claims Procedure was initiated in 2009. This regulation aims at simplifying and speeding up the small claim litigations as well as reducing the costs. The ESCP is a written procedure where the parties and the court are using standard claim forms. The idea is that the parties should be able to litigate without the help of a lawyer.

    The purpose with the present paper has been to analyze this regulations’ capacity to reach its aims, principally how the situation seems at the European level but also at the Swedish level. Since the ESCP is a relatively new procedure there is so far a limited supply of material on this subject. Due to this fact statistical reports, foreign investigations and own surveys have served as supplementary material to the traditional sources of law.

    By introducing the ESCP, which is one of the first European procedures, the EU has increased its involvement in the European civil procedure. Since the regulation of judicial proceedings earlier was handled by the national legislation of the Member States, this caused some critique. There are those who mean that the harmonization of the European civil procedure has not been sufficiently effective and that the focus on efficiency and economy has been prioritized over the fundamental procedural rights. This might also be the case for the ESCP. The procedure has namely turned out to be slightly problematic and somewhat ineffective. If the procedure differs significantly between the Member States this may also lead to differences in the level of protection. The multilingualism in Europe often demands translated documents, which runs the risk of being deterring expensive. Furthermore, the duty of the Member States to offer the parties practical assistance is inadequate, because of the lack of knowledge about the ESCP among the courts. As regards Sweden’s relations to the ESCP, the interest so far seems quite modest. The authorities have not made any widespread efforts to promote the ESCP and the courts do not even seem to have heard of this procedure.

    The prerequisite for making the ESCP really effective in practice is that lawyers and judges as well as the public are acquainted with its existence. On the European level there are several media that supplies information about the ESCP. Nevertheless, only a few are aware of these media. On the national level the efforts to promote the ESCP varies between the Member States and thus the use of the procedure throughout Europe varies as well. Overall the statistics indicates that up to now relatively few judgments have been decided in the ESCP. Consequently, the analyze has displayed that there are reasons to question the practical efficacy of this procedure. At the same time it is important to bear in mind that the ESCP is a fairly new procedure which has the possibility to improve. Since it has a good purpose there are reasons to keep the debate alive, in order to develop the procedure into the effective instrument as it aims to be.

    Abstract [en]

    This paper considers the Swedish regulations of purchase taking the perspective of private persons as a starting point. The law of purchase from the year 1990 is applicable on a number of legal purchase situations where the contracting parties varies. Nevertheless, the law is mainly focused on the purchase between businessmen. This places private persons on level with businessmen, since they are given equal responsibility regarding legal knowledge and the drawing up of contracts.

     

    In order to get a deeper knowledge of the law of purchase and to reach an understanding of how it should be interpreted we have studied the government bill on the law, cases from the Supreme Court, doctine on the area and legal articles. The purpose with this paper is to examine whether the law of purchase from the year 1990 is too old to be applicable on private purchases today. The reason would be the trade which has been modernised through the increased use of the Internet. Almost 90 % of the trade between private persons takes place through the Internet. Our intention is also to emphasise that the law of purchase lays too much responsibility on private persons and gives them too little protection at private purchases.

     

    Since the law of purchase concentrates on trade between businessmen in the first place it is most suitable for people with legal knowledge. Hence it does not seem logical that it also applies on trade between private persons. The interpretation of the law might be difficult because of its vague wording. Several rules can make it problematic for a purchaser with low knowledge of the rules to invoke the sellers responsibility for a defective good. Moreover, according to the law the purchaser has a duty to inspect the good and this must be done carefully in order to avoid a situation where the seller will be able to escape from his responsibility.

     

    As a result of this the law of purchase do not guarantee private persons any protection in practise. Since contracts are superior to the law it is possible to agree that rules involving protection should not be valid. To avoid insecurity and to secure evidence it is therefore important that the contracting parties carefully draft their contract. A comparison to the legal minimum protection of consumers clearly shows that the protection in the law of purchase seems relatively weak. Furthermore, because the law shall be interpreted in the light of secondary sources of law, which demands exstensive legal knowledge of the general public, legal security might be negatively affected.

     

    We claim that it would be possible to reach a better harmonisation between the law of purchase and the current trade behaviour through a distinction between the regulation of trade between businessmen and the trade between private persons and also by introducing cogent rules for private persons.

    The Probation Services, which is part of the Swedish Prison and Probation Services, is responsible for supervising the conditionally released and probation sentences. The purpose of this Essay in Social Work is to study probation officers dual role as a control and support function and studied from a power perspective. Previous research and literature has shown no universal definition of support, control and power, when these concepts are interpreted differently. Probation officers have a dual mission as both support and control their clients. We have conducted a qualitative study in which we performed six semi-structured interviews with three female and three male probation officers. Respondents in the study describe that control can be considered as several different things in their work, the same as support. Respondents have capacity, resources, knowledge and laws to use when they control and support their clients. Respondents argue that it is not possible to separate control and support in their work, which also revealed by the analysis. Depending on what perspective you take, an act seen as help may in a different perspective be seen as control. The concepts of control and support are defined differently by different authors, this makes it difficult to separate them. The conclusion of this study is that control and support ever-present probation officers work. It´s unable to separate these concepts and therefore can´t a definition of control and support be made, of the probation officers work. We also find that the probation officer has power. Power takes the expression in the probation officers resources and capacity, knowledge, laws and regulations and sanctions ability.

    Sammanfattning

    Avsikten med studien är att redogöra för oklarhetsregeln samt granska praxis och doktrin för att undersöka hur regeln tillämpas, och då främst i konsumentförhållanden.

          Oklarhetsregeln är en generell avtalstolkningsregel som har använts i svensk avtalsrätt under en mycket lång tid. Regeln innebär att avtalet tolkas till nackdel för den part som bär störst ansvar till att oklarheten överhuvudtaget uppstod. Det oklara avtalsvillkoret går således ut över den part som antingen författat eller åberopat villkoret eller över den avtalspart som anses vara den mest kunnige på området. Oklarhetsregeln har tillmätts särskilt stor betydelse vid ensidigt upprättade standardavtal. Sedan 1994 finns det en konsumentskyddande bestämmelse i lagen (1994:1512) om avtalsvillkor i konsumentförhållanden, AVLK, som stadgar att ett oklart villkor i ett standardavtal skall tolkas till konsumentens fördel. Oklarhetsregeln är således numer lagfäst i konsumentförhållanden, dock endast då standardavtal har brukats.

           Avtalstolkning är ett komplicerat område vilket bekräftas vid granskning av doktrin och praxis. Doktrinens syn på oklarhetsregeln och dess tillämpningsområde är inte helt enhetlig. Det går bland annat att skönja att oenighet råder angående vilken effekt lagstadgandet fått för regelns ställning i svensk rätt. Dessutom går åsikterna isär angående regelns tillämpningsområde. Det har dock konstaterats, såväl i praxis som i doktrin, att regeln har en subsidiär ställning i förhållande till andra tolkningsmetoder. Detta innebär att den gemensamma partsviljan först skall utredas, den exakta ordalydelsen granskas, normer och branschpraxis undersökas etc.

           Avsikten med den lagfästa oklarhetsregeln var att det förelåg ett visst behov av att skydda den svagare avtalsparten. Generellt sett kan sägas att konsumenten befinner sig i underläge då han avtalar med en näringsidkare. Denna skillnad i parternas styrkeförhållande blir dessutom än mer framträdande vid bruket av standardavtal. Vid granskning av prejudikat och Allmänna reklamationsnämndens, ARN:s rekommendationer kan det konstateras att oklarhetsregeln stärker konsumentskyddet och att ARN relativt ofta hänvisar till lagregeln i AVLK då det konstaterats att ett villkor är oklart.

    Abstract [en]

    The aim of this study was to find out if change in parent behavior is associated with change in preadolescent problem behavior during parent training programs. A total of 561 single parents or couples of mainly Swedish origin were randomized into one out of four parent training programs with different theoretical bases. Parents’ self-reports of their own behavior and of their children’s intensity as well as impact of problem behavior, lack of attention, and hyperactivity showed that effects were equal across interventions for both children and parents. 12 parent constructs were measured. All of them except positive parent behavior constructs correlated with all four outcomes for children on significant levels. Negative parent behavior predicted change in all child outcomes on a highly significant level.

    Abstract [sv]

    Syftet med denna översikt är att beskriva den teoretiska grunden för preventiva interventioner till barn i familjehemsvård som undergått vetenskaplig utvärdering samt att dokumentera de interventioner som används i Sverige. 20 interventioner och deras teoretiska grund beskrivs varav en används i Sverige. Majoriteten av interventionerna är selektiva eller indikerade. En tredjedel är universella. En majoritet av interventionerna är kognitivt-beteendeinriktade med social inlärningsteori som grund. Flest interventioner riktar sig till familjehemsföräldrar. Flera av interventionerna och andra interventioner med samma teoretiska grund används i Sverige, men kommer sannolikt inte familjehemsplacerade barn och ungdomar till del. I översikten konkluderas att det finns förutsättningar för att introducera fler interventioner i Sverige och utvärdera deras effekter i svensk kontext.

    Abstract [sv]

    Ca 19 000 barn under 15 år blir varje år polisanmälda för brott. Syftet med den här uppsatsen har varit att undersöka vad som händer med dessa barn, vilka insatser som görs för dem från olika myndigheters sida. Får de någon reaktion från samhället på sin brottsliga handling? Vilken är bakgrunden till att man valt att införa en straffbarhetsålder på 15 år och finns det något som talar för att den behöver ändras? Innan 15 års ålder har man inte har uppnått tillräcklig mognad för att ha ansvarsförmåga. Därför straffas inte dem under 15 år. Det övergripande samhälleliga ansvaret för de ungas sociala situation ligger på socialtjänsten och det är också socialtjänsten som har ansvaret för dem under 15 år som begår brott. I många fall får inte dessa ungdomar någon reaktion från samhället. Detta är dock inte någon grund för att straffbarhetsåldern ska sänkas, de allra flesta som begår brott under sin ungdomstid slutar med detta av sig själva utan några insatser. Det är de som inte gör det som behöver fångas upp av socialtjänsten på ett bättre sätt och få hjälp och insatser.

    Abstract [en]

    Depression is a widely spread disorder. Cognitive training could be a

    cost effective and easily accessible intervention to treat the disorder in

    an early stage. Previous research indicates that cognitive training is

    effective in alleviating depression and cognitive deficits. The aim of

    this study was to investigate whether cognitive training at home would

    lead to improvements in depression, and whether improvements were

    due to the training per se. Four subjects with depression participated

    in training with the Paced Audity Serial Addition Task (PASAT). The

    study had an n=1-design with pre- and post-measures, and control by

    a pseudo-intervention. Daily and weekly measures showed effects

    only for one participant. Thus the training was not shown to be

    effective. Three participants experienced benefits from the

    intervention. That could be a reason for further studies of cognitive

    interventions of depression.

    Abstract [sv]

    I Sverige lever i dagsläget ca 10 000 personer som gömda.  De gömda flyktingarna utgör en av de mest utsatta grupperna i Sverige. Deras rättigheter är begränsade och deras möjlighet att dra nytta av det svenska hälso- och sjukvårdssystemet är inskränkt. Uppsatsens syfte är därför att granska den nationella regleringen om hälso- och sjukvård för att se om den överensstämmer med de internationella åtaganden som skyddar rätten till hälsa och vilka Sverige har bundit sig till. Uppsatsen kommer genom fallbeskrivningar och studier att exemplifiera den gravida gömda kvinnans möjlighet att tillgå mödra- och förlossningsvård och redogöra för de hinder som begränsar hennes åtnjutande av rätten till hälsa. Mödra- och förlossningsvård skyddas i alla internationella konventioner om mänskliga rättigheter genom olika aspekter och staten har som skyldighet att se till att alla individer, inklusive gömda, omfattas av rättigheten. I Sverige erbjuds en avgiftsfri mödra- och förlossningsvård för alla gravida kvinnor med undantag för utländska medborgare, som saknar EU-kort, på tillfälligt besök och gömda kvinnor. Vårdavgiften som tas ut av de gravida gömda kvinnorna är ett hinder för dem att åtnjuta rätten till hälsa. Detta hinder borde Sverige enligt de internationella traktat som skyddar rätten till hälsa undanröja. Med nuvarande lagstiftning är de gravida gömda kvinnorna tvingade att uppsöka vård hos ideella organisationer. Vissa landsting har dock tagit fram generösare riktlinjer än den reglering som finns i nuläget vilket ger de gravida gömda kvinnorna vård på samma villkor som den i Sverige folkbokförda kvinnan. Den gravida gömda kvinnan har endast en teoretisk rätt till hälsa, medan hon i praktiken hindras av de vårdavgifter som tas ut av henne. Den nationella regleringen är således inte i enlighet med de internationella åtaganden om mänskliga rättigheter.

    Abstract [en]

    The swedish law of contract is fundamental within several civil law areas, among others labour law. The labour law contains more explicit legislation specificly adapted to the relation between employers and employees. Sometimes the labour law needs to rely on more general regulations, such as the law of contract. When the situation contains a specific contract relation dilemma it is logical to use the law of contract, when for example the law of employee protection does not reach an acceptabel solution.

    Transfer of undertaking is a situation were the employee protection is disregarded. The Euro directive 2001/23/EG prescribes, by its implemented rules in the law of employee protection, that rights and duties, such as employement agreements, passes on to the earner of the business. The employee also has the right to oppose a new employement situation which follows by the 6 b § 4 piece law of employee protection.

    Transfer of undertaking is becoming common i todays business life why it is important to analyse and clear the meaning of the transfer, from a labour law and contract law perspective. To make a contract law interpretation of what it means to leave an answer regarding a further employment is something that can involve more than as an employee oppose a continued employment. What includes the transfer of undertaking situation for an employee, in a contract law perspective? That is a question that summarizes the main purpose of this essay. My choise is to interpretate the law of contract restrictive to avoid a too general or wide meaning of the law.
