RÄDSLA FÖR SKJUTNINGAR: Finns det ett samband till nyhetskonsumtionen och en skillnad mellan män och kvinnors rädsla?2024Independent thesis Basic level (degree of Bachelor), 10 credits / 15 HE creditsStudent thesis
    Abstract [sv]

Navigating barriers and facilitators to support victims of violence in a close relationship with cognitive disability: Social workers´ perspectives2023Conference paper (Other academic)
    Abstract [en]

The risk of violence in close relationships is higher for people with cognitive disabilities than in the general population. This is due to social isolation, and physical or financial dependence on others in everyday activities. To enable adequate protection for these victims, social workers need to take decisions and provide support that is based on knowledge about both violence and disability-related needs. By contrast, people with cognitive disabilities are de facto less likely to be provided with support adapted to their needs. Therefore, this study explores how social workers navigate barriers and facilitating aspects to support victims of violence with cognitive disabilities.Data were collected in individual interviews with 18 social workers, and analysed using content analysis. The inclusion criteria were 3 years or more experience in identifying and/or assessing exposure to violence in close relationships among people with cognitive disabilities.

The emerging categories illustrate how social workers face dilemmas when navigating the balance between individuals’ rights for self-determination and complex needs for protection and support. The policies that frame social workers' practice in Sweden are discussed in relation to the need for flexible interventions and accessible support based on interprofessional collaboration related to violence and cognitive disability. The categories also problematize the power dynamics involved and how different actors’ experiences, values, and power influence the support process. The different actors involved add to the complexity that social workers need to navigate.

This presentation focus on how social workers' practice is governed and hindered by policy, a focus on individuals' rights for self-determination, and the need to support and protect a group that may have difficulties to identify both violence and their needs for support.

Year)), 20 credits / 30 HE creditsStudent thesis
    Abstract [sv]

    Abstract [sv]

    Abstract [sv]

    Abstract [en]

This study aims to investigate the impact on relatives of incarcerated individuals, as well as the availability of support services for these relatives. Additionally, the study explores whether relatives feel a sense of responsibility to contribute to the reintegration of the incarcerated individual into society. To conduct this research, semi-structured interviews have been conducted with relatives who currently have incarcerated close ones. The findings have been analyzed using shame and stigma, as well as Foucault's theory of power. Results indicate that relatives experience changes in their financial situation, feel pressure to provide support to the incarcerated one to prevent them from relapse, and often face canceled visitations. Moreover, many respondents have expressed negative views towards the justice system due to their ill treatment. Social media serves as a support system for the majority of respondents, although there is also a presence of shame and stigma within the target group in other contexts. The motivation behind studying this topic is because of the lack of research on relatives of incarcerated individuals within the Swedish context. Additionally, there is a hope that by raising this issue, relatives can actively participate in the reintegration process for their incarcerated relatives, resulting in increased well-being for both parts

    Abstract [sv]

    Abstract [en]

The purpose of this qualitative study is to investigate the experiences of professional curators and priests in working under confidentiality. The starting point is to make visible and discuss the priests' absolute confidentiality compared to the curators' confidentiality, which has certain exceptions. The empirical data has been collected through semi-structured interviews with six respondents, three from each professional group. The empirical data has then been analyzed based on Hochschild's theory of emotional labor and Lazarus and Folkman's theory of coping. The results of the study show that the different types of confidentiality both have advantages and disadvantages, and where great emphasis is placed on the expectations that existed before the professionals took on the role of curator or priest. Both professional groups are satisfied with how their confidentiality is designed and they have found strategies to deal with problems and feelings that may arise related to their respective confidentiality.

Upplevelser av KBT-behandling för social ångest och insomni: en kvalitativ intervjustudie2023Independent thesis Advanced level (degree of Master (One Year)), 20 credits / 30 HE creditsStudent thesis
    Abstract [sv]

    Abstract [en]

The aim of this study is to investigate, based on qualitative interviews, how social workers inshelters for victims of domestic violence with a child's perspective via routines and ways ofworking take into account children’s break-up from school, family and friends. The aim of thisstudy is also to investigate whether or not social workers routines and ways of working areperceived to be sufficient to contribute to maintaining continuity in everyday routines of theaccompanying children. The study was based on a qualitative method where sevensemistructured interviews were conducted with social workers in shelters for victims ofdomestic violence. The empirical data has been analyzed based on theories and theoreticalconstructs such as Lipskys theory about street level bureaucrats, Giddens theory aboutmodernity, self-identity and ontological security and also childhood studies. The resultsindicate that social workers try to maintain the children’s everyday routines by creating routinesthat include school, activities and counseling. However there are difficulties to maintain thechildren’s everyday routines because of the safety strategies in the shelters. Social workershave an awareness that their ways of working with children are supposed to be performed byhaving a child’s perspective whereas their achievement is for the families to transfer to a newindependent home to create a new belonging and everyday life.

    Abstract [en]

This study explores the reintegration challenges that former prison inmates in Sweden face, especially caused by societal labeling through the lens of labeling theory. Using qualitative analysis, this study explores podcast interviews with former prison inmates, revealing their perceptions and experiences of reintegration. Previous research highlights the difficulties of finding housing and employment as an ex-convict, while addressing the double stigmatization as a consequence of labeling for diagnoses such as adhd and challenges faced by formerly incarcerated mothers. Accordingly, the findings of this study highlight the complexities of societal reentry, where former prison inmates struggle with societal labeling, employment, and housing issues. Strategies used by former prison inmates, such as honesty, avoidance, and earning their place in society, are examined. Additionally, the positive influence of support systems like family, housing assistance, and rehabilitation programs is highlighted. The study contributes to understanding the reintegration process, suggesting implications for policy development and interventions in criminal justice and social services. The findings also indicate areas for further research, particularly around societal labeling and effective reintegration practices.

    Abstract [en]

The present qualitative interview studies are based on interviews with eight women who in the past have lived in a relationship with the occurrence of violence. The aim of this study was to illustrate heteronormative women's experiences of what they consider having been harmful and/or helpful in connection with and after the breakup from a violent relationship. The study also aimed to determine the prevalence of knowledge, support, needs and challenges that have been posed during the healing and recovery process. There is a need for greater education about domestic violence at all levels of society to gain an understanding of how relief efforts and the treatment of women and children should best be applied. There is also a lack of studies based on women's own experiences and insights into the mechanisms of violence. Many women are affected annually by the consequences of violence, where the presence and absence of knowledge and the ability to provide supportive assistance in society has come to affect all stages of the women's break-up, healing, and recovery process.

Att som äldre kvinna lämna ett våldsamt förhållande: En systematisk forskningsöversikt om äldre kvinnor som utsatts för partnervåld.2023Independent thesis Basic level (degree of Bachelor), 10 credits / 15 HE creditsStudent thesis
    Abstract [sv]

    Abstract [sv]

Two Years)), 20 credits / 30 HE creditsStudent thesis
    Abstract [sv]

Perceived Parental Engagement and Coach Support by Adolescents Within Organized Sportsand the Association with Positive Psychological and Behavioral Outcomes2023Independent thesis Basic level (degree of Bachelor), 10 credits / 15 HE creditsStudent thesis
    Abstract [en]

The aim of this study was to better understand how the supportive role from coaches and engagement from parents is associated the behavioral and psychological outcomes for adolescents participating in organized sports. Behavioral adjustments were defined as youth delinquency and psychological outcomes as depressive symptoms and subjective well-being. The data used in this study were from the Youth and Sports (YeS) project, of which an analytical sample of N=421 7th graders participating in organized sports was selected. Results from a hierarchical regression analysis showed that 7.5% of parental engagement and coach support explained variance in adolescents’ subjective well-being and 3.4% explained depressive symptoms. The same pattern was not found in delinquent behavior, however, we did find an interaction effect, where coach support moderates the link between parents’ engagement and delinquency. Therefore, results suggest that adolescents participating in organized sports with engaged parents and support from their coach displayed better behavioral and psychological adjustments in adolescence.

A Bridge Between Home and School: A qualitative study about promoting parental school involvement of immigrant parents, for enhancing children’s academic success2023Independent thesis Basic level (degree of Bachelor), 10 credits / 15 HE creditsStudent thesis
    Abstract [en]

The overall purpose of this thesis was to explore the program “Bredsands Brobyggare,” which aims to increase immigrant parents’ involvement and participation in their children’s schooling. This was achieved by studying how the “bridge builders” experience relationship building with the parents and what strategies they use while working with the target group, as well as how these strategies are considered to affect the parents’ involvement in school. In the thesis, four semi-structured interviews were conducted with service providers working in the investigated program. The results were analyzed from a hermeneutic abductive approach through a thematic analysis. Dempsey and Sandler’s theoretical model of motivational sources for parents’ involvement in their children’s schooling is the theoretical framework underlying the analysis. The results showed that the bridge builders used their cultural-understanding ability to build a relationship with the parents and increased other professionals’ awareness and understanding of their difficulties and needs. Furthermore, after establishing a relationship with the parents, the bridge builders used other approaches, such as a strength-based approach and the implementation of individualized support according to the parents’ needs, aiming to create a stable line of communication between school and home, which in turn can potentially develop parents’ involvement in their children’s schooling.

Evaluation of the Pilot Test of PIA Youth Program: A Dissonance-based Program to Promote Recently Arrived Immigrant Youth’s Motivation and Potential to Overcome Possible Challenges2023Independent thesis Advanced level (degree of Master (Two Years)), 10 credits / 15 HE creditsStudent thesis
    Abstract [en]

BACKGROUND: Availability of evidence-based intervention for recently arrived immigrant youth that does not have a medical approach is limited. Not responding to these youth with adequate support can lead to major psychosocial consequences during adolescence and in the future. The current study focuses on the evaluation of the pilot test of the PIA Youth Program. The PIA Youth Program was developed on the bases of newly arrived youth's own description of needs in a series of interviews and the research on the risk and protective factors in relation to migration and resettlement process. Therefore, the aim was to determine whether the intervention effectively promoted refugee youth’s motivation, feelings of efficacy, and view of their potential to overcome their challenges such as learning a new language, academic tasks, seeking help from others, developing a career path and sense of belongingness in the new host society. METHOD: The pilot test used a single group pre- and post-test design. Pre-and post-test outcome measures were compared to examine improvements after enrolment in the program. Paired samples t-test was used to estimate the changes. Due to the small sample size, the adjusted Cohens d effect size was used to determine the program's impact on different measures based on the commonly recommended cut-off values. A total of 29 youth enrolled in the program in Swedish, Kurdish, Somalian and Arabic, and 24 of the youth who started completed the program. RESULTS: The results suggested that the youth who participated in the program showed improvements relative to their baseline level in several of the measures. Specifically, their internal motivation to learn Swedish (d = .47), confidence in achieving academic goals (d = .28), and persistence in dealing with school difficulties (d =.22) showed a trend of increase. On the other hand, the youth who participated in their home language showed a decrease in societal belonging, which slightly increased with other youth who participated in Swedish. CONCLUSION: The results suggested that the PIA Youth Program is generally an effective dissonance-based intervention that could promote motivation to overcome challenges and maintain hope for the future for recently arrived youth. Due to the small sample size, the findings are not conclusive. However, the pilot test results could be seen as a basis for mapping, refinement, and improvement of the program before it can be tested on a larger scale using RCT design.

Turning the tide: Resisting racism against non-European refugees in Nordic countries through counter-narratives of lived experiences2024Conference paper (Other academic)
    Abstract [en]

Racism against non-European refugees and migrants is rampant in Nordic countries, contradicting their purported image of tolerance as being free from the widespread prejudice and racism non-whites face in other countries (e.g., Masoud et al., 2023; Groglopo & Suárez-Krabbe, 2023; Palmberg, 2009). Combating racism is crucial for fostering inclusivity, but challenges persist. Some refugees and migrants do not confront when experiencing racism, fearing repercussions or ostracism (PROBA, 2023). Leaders may also fail to address the root causes of racism, resorting to nonperformativity (Ahmed, 2006), silence, or indifference (Abamosa, 2023; Spiller et al., 2021). Finally, there might be genuine unawareness of the intricate nature of racism among the leadership and other people who would have resisted racism. These are just a few examples. To further understand the racism refugees encounter, we pose two research questions: How can we better grasp systemic racism to propose viable solutions? How can refugees be empowered to resist embedded racist structures and practices? To this end, we employ collaborative autoethnography (Chang et al., 2013) to share counter-narratives of our lived experiences (Lueg & Lundholt, 2021). This is pertinent to Nordic societies and the idea of Nordic exceptionalism, where racism against refugees and other minorities is often denied (Abamosa, 2024). We will propose the “Ecology of Hate” to elucidate racism’s dynamics and complexities in further marginalization of refugees. Moreover, we recommend some ways of tackling racism in institutions.

Supporting Development and Adjustment of Recently Arrived Youth: PIA Youth Program2023Conference paper (Other (popular science, discussion, etc.))
    Abstract [en]

Immigrant and refugee adolescents who migrate to a new country face acculturative-challenges in addition to their already ongoing developmental-challenges. Nevertheless, most preventive interventions for recently arrived youth focus on a small segment of this population who may potentially be at risk for mental health issues related to psychological distress and past trauma. The PIA Youth Program was developed as a cognitive dissonance-based universal intervention to support newly arrived youth in accomplishing their acculturative and developmental tasks to promote their development and social integration to the host society. The program content was informed by newly arrived youth’s own description of needs and the research on the risk and protective factors in relation to migration and resettlement processes. A single-group pre-and post-test pilot study was conducted to evaluate the effectiveness and the feasibility of the program. The pilot study aimed to determine whether the program could help the youth overcome their challenges such as learning a new language, handling academic tasks, seeking help from others, developing a career path, and feeling a sense of belonging in the host society. In addition, feasibility and process of the implementation were assessed using measures from intervention leaders and program participants. The results suggested that the youth who participated in the program improved relative to their baseline level in several outcomes. Specifically, their internal motivation to learn Swedish (d = .47), confidence in achieving academic goals (d = .28), and persistence in dealing with school difficulties (d =.22) showed a trend of increase. On the other hand, the youth who participated in the program sessions in their home language showed a decrease in societal belonging whereas the youth who participated in the mixed Swedish speaking groups showed a slight increase. In addition, reports from the intervention leaders and program participants suggested very high satisfaction with the program, high relevance of the content and high level of active engagement in discussions. Overall, the pilot evaluation suggests the feasibility and potentially positive outcomes of the PIA Youth Program. The results were used for mapping the challenges and refining and improving the program. The research team is currently running a randomized controlled trial to test the program outcome under different conditions.

    Abstract [en]

Esmeralda, also called “lilla hjärtat” was found dead at her biological parents house shortlyafter the care of her under the Care of Young Persons Act, ended. As a result of Esmeralda'stragic fate the reform “lex lilla hjärtat” was presented. This led to several changes in the lawthat came into effect on July 1 2022. The purpose of this study is to examine whether and towhat extent “lex lilla hjärtat” has had an impact on the application of law. This study hasbeen based on a qualitative method with documents consisting of verdicts that process thetermination of the care of young persons act, as the data collection method. The verdicts wereselected through a purposive selection and processed with a thematic analysis. The theoreticalperspective that has been used in this study is sociology of laws, social constructivism andchildhood sociology. The result of the study show that “lex lilla hjärtat” has had an impact onthe application of law, although not the expected level of impact. First of all, “lex lillahjärtat” has resulted in higher requirements regarding the termination of the care of youngpersons act. Furthermore the children's rights have been strengthened while the parents'interests have gotten a weakened position. However, this study shows that there is still a lackof consideration to the principle of the best interest of the child and the child's perspective.

    Abstract [en]

The reform of our time in the public sector has generated major organisational changes for the Swedish social services. The implementation of New public management [NPM] and an evidence-based practice [EBP] has resulted in a market-driven organisation focused mainly on efficiency and productivity. Reforms that were implemented with the intention of improving and developing the Swedish social service, but instead led to increased documentation requirements and more administrative tasks for the individual social worker, consequently resulting in less client-related work and a more stressful work situation. A working situation which, due to its serious nature, has become a topic of discussion for social research, trade unions and professional social workers. With serious shortcomings within social services regarding the working conditions of social workers, this study aims to investigate how social workers experience their work situation based on the challenging work environment due to the authorities processes, ethical stress and the conflicting demands that occur in their professional practice. The study is based on a qualitative research approach, using Hoschild's theories of emotions, Karasek's demand and control model and theories of ethical stress, we sought to understand the complex professional practice and work situation of the social worker. The empirical data consists of qualitative interviews with social workers working within personal and family counselling services and demonstrates, as previous research in the field has, that the workload within the agency is highly demanding. The organisational requirements are extensive and that the level of stress in the long term affects the well-being and health of the social worker. The study shows that the authorities lack understanding of the working environment which contributes to several engaged social workers turning away from social services so as not to risk suffering from ill health. The empirical evidence also shows that the lack of recovery often creates an imbalance between the sense of demand and control, which overall can lead to the social worker's ethical commitment being transformed into ethical stress. By making visible the working environment of social workers in public authorities from an ethical perspective, it is hoped that our study, despite its small size, will contribute to a new nuance in the research field, we hope furthermore to contribute to a change in the ethical aspects of the profession for the better.

    Abstract [en]

This study aims to examine social workers experiences about the child rights perspective in the processing of social assistance. The study also aims to examine how organizational guidelines affect how the child rights perspective is taken into account in the processing of social assistance. The result shows that social workers, in the role as street level bureaucrats, are affected by their discretion to what extent the child rights perspective is taken into account. Social workers also describe that knowledge about legislation is a condition for being able to take the child rights perspective into account. The results show that social workers emphasize that the caregivers have the main responsibility to fulfill their children's needs. In conclusion, the results indicate that social workers, who work with social assistance, experience that there is a limited discretion when it comes to child rights perspective in the processing of social assistance. The result also indicates that there are deficiencies when it comes to following the organizational guidelines due to high workload and resource demanding work tasks

Hippocampal subfield volumes contribute to working memory interference control in aging: Evidence from longitudinal associations over 5 years2023In: Neuroimage: Reports, E-ISSN 2666-9560, Vol. 3, no 4, article id 100189Article in journal (Refereed)
    Abstract [en]

In memory, familiar but no longer relevant information may disrupt encoding and retrieval of to-be-learned information. While it has been demonstrated that the ability to resolve proactive interference (PI) in working memory (WM) is reduced in aging, the neuroanatomical components of this decline have yet to be determined. Hippocampal (HC) involvement in age-related decline in control of PI is currently not known. In particular, the association between HC subfield volumes and control of PI in WM has not been examined previously. Here we investigate the associations between mean level and 5-year trajectories of gray matter subfield volumes and PI in WM across the adult life span (N = 157). Longitudinal analyses over 5-years across all participants revealed that reduced volume in the subiculum was related to impaired control of PI. Age-stratified analyses showed that this association was most pronounced in older adults. Furthermore, we found that in older adults the effect of age on PI was mediated by GM volume in the HC. The current results show that HC volume is associated with the ability to control PI in WM, and that these associations are modulated by age.

    Abstract [en]

The rule of law, a fundamental principle of European democratic societies, ensures that laws are clear, consistent, and applied without arbitrariness. Should the respect for the rule of law begin to backslide, Article 18 of the European Convention on Human Rights (ECHR) is meant to function as a safety device. This chapter begins by tracing how the notion of the rule of law, not a justiciable right under the ECHR as such, has been conceptualised by the European Court of Human Rights (ECtHR) and positioned in relation to the said Treaty. Next, the chapter outlines the linkage between the rule of law and the notion of European public order. Thereafter, the potential power of Article 18 is explored in relation to the anticipated function of preventing a decline in the respect for the rule of law. Additionally, the chapter traces the history of applying Article 18 and indicates unclear areas that remain with regard to the use of this provision. Furthermore, the chapter highlights the pros and cons of the contextual references increasingly relied on by the ECtHR in Article 18 judgments.

Making children's right to information meaningful in humanitarian crises2023In: Child Rights in Humanitarian Crisis: improving action and response / [ed] Rigmor Argren; Jessica Jonsson, Abingdon: Routledge, 2023, 1, p. 37-55Chapter in book (Other academic)
    Abstract [en]

The right to information, an integral part of freedom of expression, is protected by several provisions under international law. This chapter compares Article 13 of the Convention on the Rights of the Child with the corresponding provisions in Article 19 of the International Covenant on Civil and Political Rights. It is noted that the provisions of the latter are distinctively adult-centric, with a historically strong tendency towards protection of civil and political rights. It should nonetheless be remembered that Article 19 of the Covenant also applies to children. Article 13 of the Convention on the Rights of the Child must therefore be given its own distinctive meaning to add value to the legal protection of the child. This is even more vital for children in humanitarian crises. Child-specific legal protection of the right to information can be achieved when the right to information is combined with provisions protecting the child’s right to survival and development. Furthermore, only when children have access to information comprising three separate layers can it be safely assumed that their right to information has been made meaningful in humanitarian crises.

Permissive Use of Biometric Data in a Transitional Spectrum2023Conference paper (Refereed)
    Abstract [en]

Technical developments have made it possible to identify people by biometrics. The concept ‘biometrics’ refers to an individual’s characteristics and to a process. As for a person’s characteristics, the term captures both biological and behavioral features.[1] The process, on the other hand, entails automated capturing and processing of such characteristics. The use of biometrics – e.g. establishing identity by use of new technology through scanning individuals and cross-referencing their biometric data with existing databases – is on the increase, for civilian as well as non-civilian uses, for counter-terrorism activities and beyond. This raises a number of legal questions, in several legal areas. For the purpose of this research, the focus is on the interplay between the legal regimes of European Convention on Human Rights (ECHR) and the International Law of Armed Conflict (LOAC). In this way, the research seeks to cover State obligations, (what the State can do, must do, or is not at all permitted to do) in the transitional spectrum from ‘normal peace-time’ to armed conflict.

It is no longer a controversial position to hold that human rights law remains applicable also during armed conflict. Furthermore, human rights law is applicable to conflict, subject only to derogation. Lastly, when LOAC and human rights apply, LOAC is considered lex specialis, meaning it will trump human rights law in times of armed conflict if there are situations when the regimes are so much at odds that they cannot be reconciled. This may seem pretty straightforward, but if a human rights body such as the European Court of Human Rights (ECtHR) seeks to take account of LOAC in any way, first the applicability of the latter must be determined. On the other hand, turning to the ECtHR may be an effective way to redress for those who seek a remedy when a State has failed to comply with the laws. (No such option exists under LOAC).  This has given rise to a growing corpus of case-law considering potential human rights violations during armed conflict. However, the use of biometrics by armed forces (or private actors, on account of the armed forces, or the State) is certainly not limited to the context of armed conflict. In fact, the use of biometrics in ‘normal peace-time’ continues to increase, for counter-terrorist activities as well as more general security measures. In this regard, a primary human rights concern pertains to the right to privacy. The substantive right to private life is recognized in all major human rights treaties and in many national constitutions. It should be noted that the usage of biometrics throughout the transitional spectrum, is likely to engage additional substantial rights protected by the ECHR. This could include but is not limited to, the right to life (Article 2), the right to liberty and security (Article 5) the right to an effective remedy (Article 13), and naturally, the right to non-discrimination (Article 14). Furthermore, it is foreseeable that the right to freedom of expression (Article 10), which incorporates the right to information may also come into play, as will the protection of specific procedural rights developed and consolidated by the ECtHR in its case law.

Although the application of the ECHR in matters with a nexus to armed conflict generally speaking can be seen as a comparatively more recent development, the ECtHR was first seized by the broader issue of data handling and the right to private life almost 35 years ago, in the case Leander v Sweden.[2] Since then, the notion of digital privacy, as a sub-category of the right to private life has continued to emerge. Furthermore, the right to private life, as protected by Article 8 of the ECHR, has also expanded to protect biometric privacy. It is clear from the case-law, that the ECtHR is aware of the data-life cycle in that the ECtHR takes a three-pronged approach, and is scrutinizing 1) the collection, 2) retention and 3) disclosure of all data, not limited to biometrics.

Analysing the inter-play between LOAC and ECHR regarding biometrics and seeking to cover the transitional spectrum gives rise to numerous legal questions. For example: What obligations does a State party to the ECHR have with regard to biometrics and the right to private life under Article 8 a) In peace time? b) When the life of the nation is threatened? c) in armed conflict? What are the positive obligations of a State, what actions are required from the State vis-à-vis third-party actors? To what extent can a State lawfully derogate from Article 8 obligations in relation to biometrics? What questions of extra-territorial jurisdiction may foreseeably arise by the use of biometrics? Is non-compliance with Article 36 of the 1977 Protocol Additional to the Geneva Conventions of 12 August 1949, and Relating to the Protection of Victims of International Armed Conflicts pertaining to biometrics potentially of concern to the ECtHR?

This paper investigates the relationship between LOAC and human rights law as protected under the ECHR with specific regard to the use of biometrics, and discuss some of the essential questions raised above. In order to do so, it first briefly outlines the key advancements made concerning the inter-play between LOAC and the ECHR (section I). In this manner, the discussion seeks to cover the transitional spectrum from peace-time to non-international and international armed conflict alike. Next, the notion of biometrics is seen through the lens of the ECHR which protects the right to private life, and the sub-group of data privacy, including biometrics under Article 8 (section II). This is followed by a discussion concerning additional substantial rights that may come into play (section III) and procedural rights protected by the ECHR, such as the right to effective remedies (section IV). Then, the paper reconnects with the transitional spectrum, and some concepts that may be highly relevant to the use of biometrics such as derogations and extraterritorial jurisdiction are highlighted (section V). The article concludes with final remarks (section VI).

[1] Examples of behavioral features include blinking patterns, a person’s gait, driving styles or patterns of a person’s preferred game strategies. Biological characteristics include aspects of electromagnetic signals generated by heart and brain, voice characteristics, face-recognition, fingerprints, iris recognition, DNA or hand veins.[2] ECtHR, Leander v Sweden (Application no. 9248/81), Judgment, 26 March 1987. The question concerned whether or not allowing the data subject access to the information security authorities held about him violated his right to privacy.

Rule of Law in a Transitional Spectrum2024Collection (editor) (Refereed)
    Abstract [en]

This anthology is a collection of scholarly articles drawn from a series of digital webinars entitled The Rule of Law Series, hosted by Juridicum at Örebro University Sweden, during the corona pandemic in 2021. In December 2022, participants from the webinars were invited to anonsite workshop at Örebro University entitled The Rule o fLaw in a 2022 Year’s Context – Unpredictability, Digitalisationand Crises. At the workshop additional scholars interested in aspects of rule of law joined the discussions. A second round of webinars was convened in the spring 2023, which extended the network of interested researchers even further.

In this book, the rule of law kaleidoscope is examined thoroughly, and called into question. The volume contributions range from tax law, the role of the courts (specifically the EU and Strasbourg courts), digitalisation, environmental law, criminal law, and civil law. The collective enquiry undertaken in this book is guided by curiosity and a sincere desire to widely explore the adjustment and recalibration of the concept ’rule of law’ that may be required today. All is done with a desire to ensure that the rule of law remains viable in a transitional spectrum.
